I — Identification
The online store available at www.maybackpacks.com is operated by:

For the purposes of these Terms and Conditions, Kstationery, Design e Produção Gráfica, Lda. shall hereinafter be referred to as “MAY” or the “Seller”.

The products and e-commerce services made available on the website are intended exclusively for end consumers.

MAY reserves the right not to accept or process orders placed by persons who are not acting as consumers or who do not comply with these Terms and Conditions.

II — Availability
The fulfilment of all orders placed on the website is subject to availability. MAY endeavours to ensure that all items offered for sale on the website are in stock. However, MAY reserves the right not to accept orders or to cancel previously confirmed orders for products that are no longer in stock. In such cases, MAY will inform the customer and refund the amount paid.

III — Orders, Shipping and Delivery
Orders are processed after confirmation of the respective payment, unless another payment method is made available.

Products are shipped from Portugal to the destinations listed on the “Shipping” page available on the website.

Shipping costs are calculated according to the destination, weight, order volume and selected transport method, and are shown to the consumer before the purchase is completed.

The estimated processing and delivery times, calculated in business days, are available on the “Shipping” page. Delivery times begin after payment confirmation and dispatch of the order.

The stated delivery times are estimates and may be affected by circumstances beyond MAY's control, including delays by transport companies, periods of high demand, weather conditions, strikes, customs procedures or events of force majeure.

If MAY is unable to deliver the order within the agreed period or, where no specific period has been agreed, within the legally applicable period, the consumer will be informed and may exercise the rights provided for under the applicable legislation.

For deliveries made outside the European Union, customs duties, taxes, import fees or other charges imposed by the authorities of the destination country may apply. Unless expressly stated otherwise, such charges shall be borne by the recipient.

The consumer is responsible for providing a complete and accurate delivery address. If delivery is not possible due to incorrect information, the recipient's absence or failure to collect the order, the costs of a new shipment may be charged.

IV — Prices and Promotions
Prices

The prices of the products displayed are in euros and include Value Added Tax, VAT. The applicable shipping cost may be added to the price of the product, depending on the delivery address and destination country. Shipping costs may be consulted in the “Shipping” section.

MAY reserves the right to change prices without prior notice. The prices displayed at the time of purchase are the prices applicable to that purchase.

MAY shall not be bound by any offer where there are typographical, pricing or other errors in the information available on the website.

MAY reserves the right to cancel any purchase and sale agreement concluded on the basis of such errors. Promotions Offers displayed on the website are valid only for the period during which they are shown, unless otherwise stated on the website.

V — Right of Withdrawal, Returns and Exchanges
1. Right of withdrawal
Under Portuguese Decree-Law No. 24/2014 of 14 February, as currently amended, consumers have the right to withdraw freely from a contract concluded through the website www.maybackpacks.com, without having to provide any reason and without incurring any costs other than those expressly provided for by law.

The right of withdrawal may be exercised within 14 calendar days from:

a) the day on which the consumer, or a third party appointed by the consumer other than the carrier, acquires physical possession of the product; or
b) in the case of an order consisting of several products delivered separately, the day on which the consumer, or a third party appointed by the consumer, acquires physical possession of the last product.

2. Communication of the decision to withdraw To exercise the right of withdrawal, the consumer must notify MAY of their decision by means of a clear and unequivocal statement before the end of the period referred to above.

The consumer may use the model withdrawal form provided at the end of this section, although use of the form is not mandatory.

To comply with the withdrawal period, it is sufficient for the notification to be sent before the end of the 14-calendar-day period.

3. Return of products After notifying MAY of the decision to withdraw from the contract, the consumer must return or hand over the products to MAY without undue delay and no later than 14 calendar days from the date on which the decision was communicated.

Unless the product is defective, non-compliant, damaged during transport or was incorrectly sent by MAY, the direct costs of returning the product shall be borne by the consumer.

MAY does not accept returns sent cash on delivery.

Consumers are advised to use a shipping method that allows the parcel to be tracked and to keep the corresponding proof of postage until the return process has been completed.

4. Condition of returned products
The consumer may inspect and test the product to the extent necessary to establish its nature, characteristics and functioning, in a similar manner to what would be permitted in a physical retail establishment.

The consumer shall only be liable for any decrease in the value of the product resulting from handling beyond what is necessary to establish its nature, characteristics and functioning.

Whenever possible, products should be returned:
• in their original condition;
• without having been washed;
• with all labels, accessories and other accompanying items;
• inside the original packaging, where it is still available.

Opening the packaging, temporarily removing labels or normally trying the product does not automatically result in the loss of the right of withdrawal.

Where the product shows damage, dirt, stains, odours, signs of washing, alterations or other evidence of use beyond what is necessary to test it, MAY may take the resulting depreciation into account and proportionally reduce the amount to be refunded.

Where the product shows damage, dirt, stains, odours, signs of washing, alterations or other evidence of use beyond the handling necessary to establish its nature, characteristics and functioning, the consumer may be held liable for the corresponding decrease in the value of the product.

In such cases, MAY will inform the consumer of the identified depreciation and of the reasons used to determine any proportional reduction in the refund amount.

5. Refund
Where the right of withdrawal is validly exercised, MAY will refund all payments received from the consumer in relation to the returned products, including the cost of the standard delivery method initially offered for the order.

If the consumer selected a more expensive delivery method than the standard method offered by MAY, the additional cost of that delivery method will not be refunded.

The refund will be made without undue delay and no later than 14 calendar days from the date on which MAY is informed of the consumer's decision to withdraw from the contract.

MAY may withhold the refund until the returned products have been received or until the consumer provides proof of shipment, whichever occurs first.

The refund will be made using the same payment method used by the consumer for the initial transaction, unless otherwise expressly agreed.

The consumer will not incur any fees as a result of the refund.

6. Exchanges
MAY does not offer direct exchanges for products purchased through the online store.

If the consumer wishes to purchase a different product, model, size or colour, they must:
a) return the product originally purchased in accordance with this section; and
b) place a new order for the desired product, subject to stock availability.

The new order is independent of the return process and may be subject to the payment of the applicable shipping costs.

7. Defective, damaged or incorrect products If the consumer receives a product that is defective, damaged during transport, non-compliant or different from the product ordered, they must contact MAY at marketing@kstationery.com.

The consumer must provide the order number and describe the situation, attaching, whenever possible, photographs of the product, packaging and shipping label.

Such situations will be handled in accordance with the statutory rights applicable to the lack of conformity of goods and are not dependent on the exercise of the right of withdrawal.

Once the complaint has been confirmed, the necessary costs of returning, collecting, repairing or replacing the product will be borne by MAY, in accordance with the applicable legislation.

8. Exclusions from the right of withdrawal The right of withdrawal does not apply in the circumstances provided for by law, including the supply of:

a) products made to the consumer's specifications or clearly personalised;

b) sealed products that are not suitable for return for health protection or hygiene reasons once opened; or

c) other products covered by the legally established exceptions.

These exclusions will only apply where they are appropriate to the nature of the product and have been communicated to the consumer before the order is completed.

9. Model withdrawal form The consumer should only complete and submit this form if they wish to withdraw from the contract.

VI — WarrantyAll products are covered by a three-year statutory warranty in accordance with Portuguese Decree-Law No. 84/2021 of 18 October, as currently amended. In the event of a manufacturing defect, the customer must contact Customer Support at the following email address: marketing@kstationery.com.

VII — Liability MAY shall only be liable for damage suffered by the customer where such damage results from a breach attributable to MAY of its contractual obligations towards the customer, or where MAY's liability arises under the applicable law.

VIII — Personal Data Protection Kstationery, Design e Produção Gráfica, Lda. processes the personal data of users and consumers in accordance with the General Data Protection Regulation and other applicable legislation.

The personal data required for processing orders, payments, deliveries, invoicing and customer support is processed for the purposes of performing the contract, complying with legal obligations and pursuing other legally applicable grounds for processing.

IX — Alternative Resolution of Consumer Disputes In the event of a consumer dispute, the consumer may refer the matter to an Alternative Consumer Dispute Resolution entity.
